The master’s thesis was discussed at the College of Law at Al-Qadisiyah University, entitled (Legal Regulation of Voluntary Medical Work – A Comparative Study) by researcher Farah Sarmed Abdul Aziz, under the supervision of Assistant Professor Dr. Hussein Obaid Shawat
The thesis aimed to clarify the ambiguity in the laws regarding how to regulate volunteer medical work, which has made it difficult to determine the rights and duties of volunteer doctors and their legal responsibility in the event of medical errors, especially in the absence of formal contracts or agreements. Research into this topic will reduce this ambiguity, which constitutes a challenge worthy of study and regulation.
The most important conclusion is that volunteer medical work provides medical care to those in need, especially in times of crises and disasters, within a humanitarian and ethical framework. However, the work remains subject to ethical and legal controls that achieve a balance between humanitarian duty and legal responsibility, making it a fundamental pillar supporting the health system during crises, thus enhancing the quality and sustainability of this work.
The most important recommendations include ensuring that volunteer doctors in this work have the necessary medical qualifications and ensuring that their work is conducted in a safe environment that complies with health standards. These doctors’ rights, such as health and safety insurance and compensation for damages, should also be guaranteed, in coordination with hospitals and clinics to provide a suitable work environment.
