The Master’s thesis, entitled “The Right of Future Generations to Achieve Development According to the 2005 Constitution of the Republic of Iraq,” was discussed at the College of Law, Al-Qadisiyah University. The thesis was presented by researcher Buthaina Hamid Kadhim and supervised by Professor Dr. Adnan Ajil Obeid
This thesis aimed to clarify the international legal basis for the rights of future generations in the areas of peace, the environment, and natural resources. It did so by reviewing and analyzing the most important relevant international conventions and declarations, assessing the extent to which they affirm the protection of future generations’ rights, and examining the principles and legal obligations they contain that can be used to strengthen this protection. The thesis also explored the constitutional basis for these rights under the 2005 Constitution of the Republic of Iraq, analyzing relevant constitutional provisions and demonstrating the possibility of deriving constitutional protection for the rights of future generations, despite the absence of an explicit constitutional provision directly establishing them.
The thesis concluded that achieving development and ensuring its sustainability is closely linked to the availability of peace and security, given the obstacles that armed conflicts, violence, and terrorism pose to development and the enjoyment of rights and freedoms. International conventions and declarations have emphasized the importance of peace as a human right and a prerequisite for enjoying other rights.
The most important recommendation is to explicitly stipulate the right to peace as an inherent constitutional right for every individual, while obligating the state to establish a culture of peace and promote coexistence. Peace, tolerance, and the preservation of security and stability are emphasized. The recommendations also include enacting a law specifically addressing the prevention of armed conflicts and the promotion of peace, amending the Counter-Terrorism Law No. (13) of 2005 to enhance its effectiveness in combating terrorism, and strengthening Iraq’s contribution to international and regional efforts aimed at maintaining international peace and security.
